Please read these terms carefully before using our services

1. Definitions

  • "PrimeBird", "we", "us", "our" — PrimeBird Poultry Limited, a company registered in Kenya.
  • "Customer", "you", "your" — Any individual or business entity using our website or purchasing our products.
  • "Website" — www.primebirdpoultry.co.ke and all associated subdomains.
  • "Products" — All chicken and poultry products, value-added products, and related items offered for sale.
  • "Services" — Online ordering, delivery, wholesale supply, and related customer services.
  • "Order" — A confirmed request to purchase Products through our Website or other sales channels.

2. Acceptance of Terms

By accessing our Website, creating an account, or placing an order, you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, please do not use our services.

You must be at least 18 years of age to create an account or place an order. By using our services, you represent and warrant that you meet this age requirement.

3. Account Registration

  • • You must provide accurate, complete, and current information when creating an account.
  • • You are responsible for maintaining the confidentiality of your login credentials.
  • • You are responsible for all activities that occur under your account.
  • • Notify us immediately at support@primebirdpoultry.co.ke if you suspect unauthorised access.
  • • We reserve the right to suspend or terminate accounts that violate these terms or are used fraudulently.
  • • Wholesale accounts require additional verification (business registration, KRA PIN) and are subject to credit approval.

4. Products & Pricing

  • • All prices are listed in Kenya Shillings (KES) and are inclusive of VAT (16%) where applicable.
  • • Prices may change without prior notice. The price at the time of order placement is the price you pay.
  • • Product images are for illustration purposes. Actual products may vary slightly in appearance due to the nature of fresh produce.
  • • Product weights are approximate. Actual weight may vary by up to ±5% from the listed weight. You will be charged for the actual weight delivered.
  • • We make every effort to ensure product availability, but reserve the right to limit quantities or discontinue products.
  • • Promotional prices and discounts are valid for the stated period only and cannot be combined unless explicitly stated.

5. Orders & Payment

5.1 Placing Orders

  • • An order is a binding offer to purchase once you complete checkout and receive an order confirmation.
  • • We reserve the right to refuse or cancel orders due to pricing errors, stock unavailability, suspected fraud, or other valid reasons.
  • • Minimum order values may apply for delivery: KES 500 for Nairobi, KES 1,500 for upcountry.

5.2 Payment

  • • We accept M-Pesa (Paybill/Till/STK Push), Visa/Mastercard, and bank transfer (wholesale).
  • • Payment is required at the time of order unless you have an approved wholesale credit account.
  • • All payments are processed through secure, PCI-DSS compliant payment gateways.
  • • A valid KRA eTIMS tax invoice is issued for every transaction as required by Kenyan tax law.

5.3 Order Cancellation

  • • You may cancel an order within 30 minutes of placing it, provided it has not been dispatched.
  • • After dispatch, cancellation is not possible — please refer to our Returns Policy.
  • • Cancelled orders paid via M-Pesa are refunded within 24 hours. Card refunds take 3–5 business days.

6. Delivery

  • • Delivery zones, rates, and timelines are detailed on our Shipping Info page.
  • • Delivery timelines are estimates, not guarantees. We are not liable for delays caused by traffic, weather, security incidents, or force majeure events.
  • • Risk of loss and title for products passes to you upon delivery.
  • • You must inspect products at the point of delivery. Any visible damage or shortage must be reported to the rider immediately and noted on the delivery receipt.
  • • If no one is available to receive the delivery after two contact attempts, the order is returned. A re-delivery fee of KES 200 applies.
  • • We are not responsible for product quality deterioration after delivery due to improper storage on your part.

7. Returns & Refunds

Our full returns and exchange policy is available on the Returns & Exchanges page. Key points:

  • • Quality issues must be reported within 2 hours of delivery with photo evidence.
  • • Approved claims are resolved with a full replacement or refund.
  • • We do not accept returns for change of mind, cooked products, or items stored incorrectly after delivery.
  • • Refund timelines: M-Pesa (24 hours), Card (3–5 business days), Bank Transfer (2–3 business days).

8. Wholesale Terms

Additional terms for wholesale/trade customers:

  • • Wholesale pricing is available for orders of 50 kg and above.
  • • Credit terms (net 7/14/30 days) are available upon approval and are subject to a signed credit agreement.
  • • Late payments incur interest at 2% per month on the outstanding balance.
  • • PrimeBird reserves the right to suspend supply and withdraw credit terms for overdue accounts.
  • • Custom orders (specific cuts, packaging, labelling) require a minimum 48-hour lead time and may be non-refundable.
  • • Wholesale prices are confidential and may not be disclosed to third parties.

9. Intellectual Property

  • • The PrimeBird name, logo, brand identity, product images, website design, and all content are the property of PrimeBird Poultry Limited.
  • • You may not reproduce, distribute, modify, or create derivative works from our content without prior written consent.
  • • You may share product links for personal, non-commercial use.

10. User Conduct

When using our Website and Services, you agree not to:

  • • Use the Website for any unlawful purpose or in violation of Kenyan law.
  • • Provide false or misleading information when registering or placing orders.
  • • Attempt to gain unauthorised access to our systems, databases, or other users' accounts.
  • • Use automated scripts, bots, or scrapers to access the Website without permission.
  • • Resell PrimeBird products without a written distribution agreement.
  • • Post defamatory, abusive, or harmful content in reviews or communications.

11. Limitation of Liability

  • • Our total liability for any claim arising from your use of our services shall not exceed the amount paid by you for the specific order in question.
  • • We are not liable for indirect, incidental, consequential, or punitive damages including lost profits or business interruption.
  • • We are not liable for damages arising from product misuse, improper storage after delivery, or failure to follow cooking instructions.
  • • We provide the Website "as is" without warranties of uninterrupted or error-free operation.
  • • Nothing in these terms excludes liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded by Kenyan law.

12. Indemnification

You agree to indemnify and hold harmless PrimeBird Poultry Limited, its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your breach of these terms, misuse of the Website, or violation of any applicable law.

13. Governing Law & Disputes

  • • These Terms are governed by the laws of the Republic of Kenya.
  • • Any disputes arising from these terms shall first be resolved through good-faith negotiation.
  • • If negotiation fails, disputes shall be referred to mediation under the Nairobi Centre for International Arbitration (NCIA) rules.
  • • If mediation is unsuccessful, disputes shall be submitted to the courts of Kenya with jurisdiction in Nairobi.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a banner on the Website at least 14 days before taking effect. Continued use of our services after the effective date constitutes acceptance of the revised terms. We encourage you to review this page periodically.
